SURGICAL OUTCOMES Information Exchange SOIX® believes you should be aware
of what information is collected when you access our websites and how SOIX® utilizes this information. This Privacy
Policy sets forth the guiding principles regarding the collection, analysis,
utilization and disclosure of such information. Please read this Privacy Policy
carefully. Use of any SOIX® websites
signifies your understanding and acceptance of this Privacy Policy.

 SOIX® since May 2001 is a member of Health
on the Net. We intend to abide by the requirements of the Code of Conduct
set forth in the HONcode.

Capturing
Personal Information about Our Visitors
SOIX® does not capture personal information
about any visitor to our website without their permission. We endeavor to collect, in
an anonymous fashion, only the minimum amount of information needed
to meet the purposes for which our network was created and to provide the services
or benefits you desire. For each visitor, we collect information about the
Internet Protocol (IP) address, browser-type used, the date and time of the
visit as well as the IP addresses of the locations to which the visitor linked
during the visit to our website. This information may be stored on SOIX® servers. It is strictly used for internal,
statistical reporting purposes such as analyzing trends, website administration,
tracking user’s movements and gathering broad demographic information
for aggregate evaluation. IP addresses are not linked with any personally identifiable
information.
Though personal information
may be required either by law or in order
for us to provide a requested service,
in doing so we are subject to the requirements
for administering information systems as
established in the Virginia Privacy Protection
Act, Chapter 26 of Title 2.1 of the Code
of Virginia.
Nondisclosure
of Member Information
SOIX® does not sell or rent our member
information to any outside company or organization. We do not reveal specific
information about members or other personally identifiable data to unaffiliated
third parties for their independent use.
Secure Communication
SOIX® since the version OMS-5.1 uses secure webserver connection for user communications and data upload so that it complies with all HIPAA data security regulations.
Cookie
Utilization
A cookie is a piece of text saved from a web server that can be stored on your
hard disk. Cookies allow a user machine to store website information and retrieve
it at a later date. A cookie is not a program. It is simply a text information
file that cannot "do anything." A server can only retrieve information
off the user machine that you have put there. It cannot retrieve information
from other cookies or any other information from your machine. Some of our
website pages may use cookies.

Adult Usage
The SOIX® Websites are intended for use by persons that are at least 18 years
old. If You are less than 18 years old, you may not access any SOIX® Website
or order products or services from SOIX®. If You are a parent or other person
charged with the care of persons under 18 years old, You agree to restrict
access to the SOIX® Websites through Your computers to persons who are at
least 18 years old. If one of Your children accesses an SOIX® Website and
provides SOIX® with Personal Information (as defined in the Privacy Policy),
please click here to contact SOIX®. SOIX® shall use reasonable efforts to delete
all Personal Information regarding your child from its databases.

Advertisers and Sponsors
SOIX® is not supported either by advertisers
or sponsors. Our financial support comes solely
from our member contribution as membership fees.
There are no links from the SOIX® website to
any commercial websites or product vendors.

Third Party Web Sites
The SOIX® Websites may provide links to web sites
not operated by SOIX® (collectively, "Third
Party Web Sites"). SOIX® provides links
to Third Party Websites for your convenience.
Such links may be removed at any time. SOIX® does not investigate the quality, accuracy or
completeness of any content on Third Party Websites.
SOIX® HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS
AND WARRANTIES REGARDING THE THIRD PARTY WEBSITES.
You also acknowledge and agree that SOIX® is
not responsible or liable for any content, advertising,
products or other materials on or available
from Third Party Websites.

Warranties and Limitations of Liability
You acknowledge and agree that any and all disclaimers in these Terms and
the provisions of this Section 6 reflect a fair and reasonable allocation
of risk between SOIX® and You and such allocation is reflected in the fees
payable by You to SOIX®.
Your use of the SOIX Websites is solely at your risk. SOIX® HEREBY DISCLAIMS
ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, REGARDING
CONTENT, THE SOIX® WEBSITES, AND THE PRODUCTS AND SERVICES PROVIDED BY THE
SOIX® WEBSITES INCLUDING ANY WARRANTIES OF AVAILABILITY, NON-INTERCEPTION,
FREEDOM FROM VIRUSES, ACCURACY, RELIABILITY, CORRECTNESS, TIMELINESS, COMPLETENESS,
NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
YOU HEREBY AGREE THAT SOIX® AND ITS OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES,
SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES, CLAIMS, DEMANDS OR CAUSES OF
ACTION, WHETHER IN TORT, CONTRACT OR OTHERWISE, WHETHER DIRECT OR INDIRECT,
SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE, AS A RESULT OF YOUR USE OF
THE SOIX® WEBSITES, CONTENT OR THE PRODUCTS AND SERVICES PROVIDED BY THE SOIX® WEBSITES. IF THE FOREGOING LIMITATION IS UNENFORCEABLE, YOU AGREE THAT SOIX’S
LIABILITY TO YOU, WHETHER IN TORT, CONTRACT OR OTHERWISE, SHALL NOT EXCEED
$1,000.

Indemnity
You agree to indemnify and hold harmless SOIX® and its directors, officers,
employees and agents from and against any and all claims, actions and proceedings
and any and all costs, fees (including attorney’s fees), expenses,
settlements, and judgments that result from Your breach of these Terms.

Copyrights and Trademarks
All Content is copyrighted by SOIX®. All other trademarks and service marks
are the property of their respective suppliers. No right is granted by these
Terms to use any of such trademarks or service marks.
10.
Miscellaneous
These Terms, together with our Privacy Policy and any other agreements that
may be entered into by You and SOIX® in connection with a specific products
or services of SOIX®, constitute the entire agreement between You and SOIX
and supersedes any and all other agreements, representations and understandings,
whether written or oral. These Terms may not be modified or amended by You
without the prior written consent of SOIX®. SOIX® may modify or amend these
Terms and the Privacy Policy at any time without notice to You. You should
regularly review these Terms for any modifications or amendments to these
Terms as your continued use of any SOIX® Website after a modification or amendment
signifies your asset and agreement to these Terms, as amended. If any clause
or provision set forth in these Terms is determined to be illegal, invalid
or unenforceable under present or future law, then, You understand and agree
that the clause or provision so determined to be illegal, invalid or unenforceable
shall be severable without affecting the enforceability of all remaining
clauses or provisions. These Terms and Your use of the SOIX® Websites and
any products and services provided by the SOIX® Websites shall be governed
by the laws of the United States of America and the State of Virginia. The
state courts located in or serving Henrico County, Virginia shall have exclusive
jurisdiction over any and all claims, disputes or other controversies relating
to or arising from these Terms or Your use of the SOIX® Websites or any products
and services provided by the SOIX® Websites. You hereby expressly consent
to the exercise of jurisdiction over you by such courts. To the fullest extent
permitted by applicable law, each party to this Agreement waives its or his
right to a jury trial with respect to any action brought under or in connection
with this Agreement. The headings used in these terms of use are for convenience
only and such headings are not to be used in determining the meaning or interpretation
of these terms of use.
